These Terms of Service ("Terms") govern your access to and use of Encode ("Encode", "we", "our") websites, products, and services. Encode is operated by Endurer. By creating an account or using our services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services. By using our services, you confirm that you meet this requirement.
2. Accounts and security
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and up-to-date information when registering.
- You must notify us promptly if you suspect unauthorized access.
3. Service use
- You may use the services only in compliance with applicable laws and these Terms.
- You may not use the services to generate, distribute, or amplify harmful, misleading, or illegal content through AI inference.
- You may not attempt to reverse-engineer, extract, or replicate AI models accessed through the service.
- We may suspend or terminate services that violate these Terms or present security risks.
4. Plans and billing
- Encode is priced per Worker, per month or per year, as described on our website. Prices exclude VAT and may change with notice.
- A Worker has no session or usage caps.
- During the pre-release, subscriptions are not on sale; Encode launches in January 2027. When pre-orders are open, Workers can be pre-ordered under section 5. Leaving your email address for notifications is not an order and creates no obligation for you or for us.
- Payments are processed through our payment partners (e.g., Stripe).
- You authorize us to charge your selected payment method for your recurring subscription.
5. Pre-orders
- Before Encode becomes publicly available, planned for January 2027, business customers can pre-order Workers of the Autonomous Junior Software Engineer + Human Verification plan while pre-orders are open. Pre-orders are for businesses only: by pre-ordering you confirm that you act for a business, not as a consumer.
- A pre-order is a subscription for the number of Workers you choose (1 to 20 per pre-order), billed monthly or yearly. When you pre-order, our payment provider Stripe saves your payment method. Your first payment is on the day Encode becomes publicly available ("launch day").
- Until launch day your subscription is in a trial period and no payment is taken. On launch day we end the trial period of every pre-order at the same time and charge the first invoice. The trial period ends no later than the end of January 2027; Stripe's checkout page shows that latest date. If launch moves later, we extend the trial period of every pre-order and tell you by email before it would have ended, and your first payment stays on launch day.
- Pre-order discount: with yearly billing, 15% off your first annual invoice; with monthly billing, 5% off your first 12 monthly invoices. The discount starts with your first paid invoice after launch; the trial period uses none of it. Each pre-order placed before launch day gets the discount for its own Workers. Workers added to a subscription after launch day, and subscriptions started after launch day, are at the list price. After the discount the list price applies, currently €42,000 per year or €3,500 per month per Worker. Prices exclude VAT; VAT is added where it applies, and with a valid EU VAT number from outside the Netherlands the reverse charge applies.
- You can cancel a pre-order at any time before launch day from the Subscription page of your Encode dashboard, at no cost. No payment has been taken by then, so there is nothing to refund.
- From launch day the subscription runs like any other: it renews each month or year until you cancel it, and a cancellation takes effect at the end of the current billing period. Payments already made for a period are not refunded.
- If a payment fails, we retry it for up to two weeks and email you a link to pay or to update your payment method. Your Workers keep running while we retry. If the payment still fails, the subscription is marked unpaid and its Workers stop until it is paid.
- We email you the exact launch date before billing starts.
- We may stop accepting new pre-orders at any time. Pre-orders already placed keep these terms.
Pre-order terms of 2 November 2026. A pre-order keeps the version in force when it was placed; we keep every version and send it to you on request.
6. Service availability
We strive to maintain high availability but do not guarantee uninterrupted service. Maintenance windows, outages, or external dependencies (including third-party AI providers) may impact uptime.
7. Data and content
You retain all rights to your content and data. Encode processes your content only to provide the services you request. Content submitted for AI inference is not used to train models.
8. Intellectual property
Endurer retains all rights to the Encode service, software, and branding. You retain rights to your content and data that you create or upload.
9. Termination
You may cancel your services at any time. We may suspend or terminate your access if you violate these Terms or fail to pay fees when due. Upon termination, your data may be deleted in accordance with our retention policies.
10. Disclaimer of warranties
Services are provided "as is" and "as available." AI-generated output may contain errors and should not be relied upon without review. We disclaim all warranties to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, Endurer is not liable for indirect, incidental, or consequential damages, or loss of profits or data. Our total liability for any claim is limited to the amount you paid for the service in the 3 months preceding the event.
12. Changes to terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date.
